Orange County Grand Jury Indicts Irvine Man of Murdering His Father

On August 30th, 60-year-old E.B. was fatally shot in his home. An Orange County grand jury has formally accused his 21-year-old son of committing the crime, saying he shot his father following an argument regarding money. After shooting his father, he allegedly locked his father's body in his bedroom, stole his father's car, and attempted to escape by fleeing to Colorado. The next afternoon, family members alerted the authorities when they found a large pool of blood in the home in Irvine. Only hours later, the victim's son, S.B., was arrested in Colorado.

S.B. is currently being held in California without bail. If he is convicted of what he has been indicted for, he could be facing extremely serious penalties. The California Penal Code §§187-199 (2011) gives information regarding the types of murder charges as well as the specific penalties which could result from a conviction. Murder is defined as the "unlawful killing of a human being, or a fetus, with malice aforethought." First degree murder can result in the death sentence, life in prison without the possibility of parole, or 25 years in state prison. Second degree murder can result in a prison term of at least 15 years but it could extend up to life.

Some types of situations which could cause a person to be convicted of first degree murder include if the murder was purposeful and occurred because the guilty party was looking for financial gain. Also, if the individual was ever convicted of first or second degree murder in the past, they will be convicted of first degree murder for a second offense.
