Medical Marijuana & Drug Crimes

Were you arrested for medical cannabis use?

Medical marijuana or medical cannabis is a type of herbal therapy made from the cannabis herb. This herb has been used for medicinal purposes for thousands of years and is even used as a prescription drug in some countries today. The benefits include relief from symptoms and treatment of diseases like AIDS, arthritis, cancer, multiple sclerosis, cachexia, chronic pain, and more. Sometimes, people are arrested for cannabis use even though their use was medicinal.

The Compassionate Use Act of 1996 is a California law that allows marijuana to be used by the public for medical reasons. Provided they obtain a doctor's recommendation, they are able to not only possess, but cultivate marijuana. In 2003, another law was passed in the California State Legislature regarding medical cannabis. The legal limit is eight ounces of marijuana or six to twelve plants. However, if necessary, a doctor can authorize patients to grow more. A Los Angeles drug defense attorney from Martinian & Associates could assist you for an arrest related to medical marijuana use.

Qualifying for MMIC

Under California Proposition 215 and Senate Bill 420, certain individuals can qualify for an MMIC (Medical Marijuana Identification Card). These cards and this entire program are managed by the California Department of Public Health's medical marijuana program (MMP). To learn whether or not you qualify for an MMIC, you will need to speak with a qualifying physician.

This physician will have to approve of or make a diagnosis of the condition. In order to apply for the MMP, you must visit your Local County Public Health Department. If you can supply the necessary medical evidence from your physician, then you can be issued an MMIC. Patients who do not live close enough to a qualified medical marijuana dispensary may be allowed to grow their own marijuana. At any given time, a qualified patient may not possess more than 8 ounces of cannabis.

Even though this is sanctioned by governing authorities, arrests can still be made in regards to medical marijuana. Under state law, certain instances of marijuana possession are legal, but under federal law it is still illegal. Possession can lead to up to six months in jail as well as fines of up to $500. Cultivating marijuana is classified as a felony and can lead to up to three years in state prison. Sale is an even more serious crime which can result in seven years imprisonment.
